A mistrial was declared Saturday morning after jury deliberated for more than 24 hours in a fatal Cincinnati police-involved shooting.
University of Cincinnati Police Officer Ray Tensing was charged with murder and voluntary manslaughter in the shooting death of Sam DuBose during a traffic stop in July 2015, according to WLWT-TV.
The jury was directed to consider murder first during deliberations and if they were unable to reach a verdict -- or found the officer not guilty -- they were to move on to voluntary manslaughter.
The jury told the court that they could not reach an unanimous decision on either charge.
Assistant prosecuting attorney Mark Piepmeier argued that Tensing was guilty of murder, while Defense attorney Stew Mathews argued that Tensing was justified in shooting DuBose because he was in fear for his life.
The next court date is set for Nov. 28 and Tensing's bond was continued.
