The mother of a teen killed by Chester City police in 2010 during a shootout in which an officer was wounded filed a wrongful-death lawsuit Thursday against the city, the police department and Delaware County investigators.
Valerie Myers, of Philadelphia, claims in her civil rights action in federal court that excessive force was used against her 16-year-old son, Andre Morales. She is seeking damages of more than $100,000, according to court papers.
In June 2010, Morales and Shaquille Byrd entered a garage in the 300 block of Rose Street to rob a card game, police said at the time. In the ensuing gunfight, Officer Luis Rodriguez was shot in the arm by another officer.
Morales fled the scene, dying in a nearby field. Byrd, then a Chester High School basketball player, was wounded. He pleaded guilty to robbery and other charges was sentenced to 10 years in prison.
