DAYTON - A corrections officer employed by the Montgomery County Sheriff's Office has been indicted on four felony counts of theft in office.
Malcolm Capps, 36, is accused of stealing money from inmates being processed into the county jail.
Capps, a nine-year veteran of the sheriff's office, was indicted by a county grand jury last Friday, according to Montgomery County Prosecutor's Office spokesman Greg Flannagan.
The allegations come after sheriff's officials reviewed video surveillance showing corrections officers logging individuals' personal possessions as they are processed into the jail. The sheriff's office released the video footage to media on Thursday.
Sheriff's Maj. Daryl Wilson said during the review of the tapes that concerns were raised as Capps appears to be pocketing cash from inmates on several occasions.
The indictment lists incident dates of Feb. 28 and March 4.
Capps of Union is on unpaid administrative leave while the criminal allegations are investigated, Wilson said.
If convicted, Capps could face up to a year in prison on each fifth-degree felony count.
"If he's convicted, it would be up to the sheriff to decide what to do" in regards to Capps' employment with the sheriff's office, Wilson said.
Police did not disclose the amount of money that was alleged to have been taken or how many inmates were affected.
Capps' attorney Frank Malocu said he's confident of his client's innocence.
"I think it's a matter of interpretation as far as any videotaped incidents," Malocu said.
