Squirt Gun Game Nearly Turns Deadly in Calif.

March 25--MODESTO -- It's called "Assassin," a game loved by high schoolers that's only as lethal as a squirt gun.

"The game consists of seniors driving around trying catch each other and to shoot each other with water guns," said Deputy Tom Letras of the Stanislaus County Sheriff's Department.

But for a group of Modesto High School seniors Friday night, the danger went from flying water to flying bullets. Deputies say Friday night, a car full of teens playing "Assassin" pulled up to the light at Pelandale and Tully Roads and open fire with squirt guns on what they thought was their intended target, a red pickup truck.

"The victim they shot didn't happen to be another senior it happened to be someone uninvolved in the game," Letras told FOX40.

Benito Victory, 26, of Lodi, and his girlfriend were inside the truck and got soaked. Instead of laughing off the drenching, Victory took off after the teens.

"As he was chasing them, information we got is that he fired several rounds out of a handgun at the teens," said Letras.

Deputies say he chased and fired rounds from a handgun until he finally flipped his truck on the 6300 block of Carver Road.

"Immediately after the crash, while his girlfriend was still trapped inside the vehicle -- he wandered into homes, into yards, saying he was looking for his GPS device," said Letras. Deputies believe that's when he stashed the gun, they searched for two hours in grass and weeds, but never found it.

Victory was only arrested on suspicion of driving under the influence, but the charges could get more severe if the weapon he allegedly used is found.
