Waukesha - A former Village of Mukwonago police officer was sentenced to three months in the work-release jail for falsifying records to benefit his girlfriend Alvin J. Brook, 42, was also ordered by Waukesha County Circuit Court Judge Kathryn Foster to two years'probation.
He entered a no-contest plea to a felony count of misconduct in office for altering documents related to preliminary breath tests for his girlfriend. Foster ordered Brook to five months in jail, but stayed the last two months of the sentence.
According to the criminal complaint:Brook's girlfriend was convicted of third-offense drunken driving and was participating in the Waukesha County Alcohol Treatment Court. As such, she was required to submit to random preliminary breath tests to confirm she had not been consuming alcohol. The program allows local police departments to administer the tests, but they must date stamp a verification form and keep a log of when the person came to the police department.
To meet that requirement, the woman went to the Village of Mukwonago Police Department and between Jan. 7 and June 3, 2010, submitted 62 testing verification forms to the Alcohol Treatment Center.
Of that number, 52 forms were completed by a Mukwonago police officer and 10 were done in the Village of Big Bend.
All 52 of the Mukwonago forms were completed by Brook, but according to Mukwonago police records, 30 of the tests were conducted when Brook was not on duty and 11 of those when he was not working that day at all.
On 16 of the occasions, the forms were completed between 7:05 and 7:35 a.m. although on each of those days, Brook did not start work until 7:45 a.m.
On three other occasions, Brook was at work, but dispatch records show he was not at the Police Department but on another call.
Also, none of the woman's tests were entered into the dispatch records.
