SHIRLEY, Mass. --

A man was killed and another seriously injured when they fell out of a bus’s bathroom window during a return-trip to Massachusetts after a New Hampshire brewery tour Saturday night, according to Massachusetts State Police.

The group on the charter bus had just visited the Red Hook Brewery in Portsmouth and was en route to Gardner, Mass., when police responded to the call, said police.

An initial police investigation reports Thomas Johnson, of Gardner, Mass., and Seth Davis, of Winchendon, Mass., fell out of the window onto Route 2 westbound in Shirley, Mass.

Police said alcohol appears to have been the contributing factor in the incident. Police said the men had been fighting.

The men were found in the breakdown lane by a Massachusetts trooper responding to an unrelated call. Shortly after the trooper found the men, state police said the bus driver for Colonial Tours of Boston called them and said someone had just fallen from the bus.

Police said Johnson died at the scene, while Davis was taken to the University of Massachusetts Medical Center in Worcester with serious injuries; he is in critical condition.

Officials said there were about 55 people on board.

No charges were filed, but the incident remains under investigation by authorities. Police said they are questioning other passengers.
