10:00am - 12:00pm - Use of Force - Use of force is one of the top five prisoner-filed litigation suits yet few jail and correction officials know what the courts have to say about use of force in jails. The vast majority of jails across the United States employ policy, procedure and training on use of force that is a derivative of the objective reasonableness test. This workshop will explain the difference between the application and justification of use of force in jails and how to proactively address issues to defend against litigation.
12:30pm - 2:30pm - First Amendment/ Legal Issues - This workshop provides a review of First Amendment issues for jails, including speech (inmate communication: mail) and religion using the four factors outlined in Turner v. Safley to provide guidelines for administrative discretion for having defensible policy and procedure.
2:45pm - 4:45pm - Emergency and Contingency Planning - Jails must plan and prepare for a variety of emergencies. This seminar reviews issues jail and corrections officials face from disease to catastrophe. Learn proactive strategies to prepare for the unexpected and the unwanted.
5:00pm - 6:00pm - Not So "Best Practices" - Legal-based vs. Best Practices - What is the difference between legal-based guidelines and the philosophy-based standards so often referred to as "best practices" in jails? For jails that are looking at policy and procedure, this seminar will explain what the federal courts have ruled and what federal statutes require with respect to incarcerating prisoners instead of a one-size-fits-all standard for all jails.
