YORK, VA — A state trooper was taken to the hospital on Wednesday after a driver sideswiped his vehicle while stopped on the shoulder of Interstate 64.

Around 3:13 a.m., Trooper B. Nicholson was stopped on the shoulder for a traffic stop at mile marker 236. While he was inside his vehicle, it was struck by a 2000 Ford Contour, according to a news release from Virginia State Police.

The driver of the Contour, 63-year-old Johnnie Ray Davis of Hayes, was charged with reckless driving. Davis was not impaired at the time of the crash, and speed was not a contributing factor, police said.

The release stated that Nicholson's vehicle, a 2021 Ford Explorer, had emergency equipment activated and properly functioning.

Nicholson sustained injuries that were not deemed life-threatening, and he was taken to Sentara Williamsburg Regional Medical Center. State police withheld the officer's first name.

In Virginia, drivers are required to move over or slow down when vehicles are stopped on the side of the road, including vehicles that are:

  • Displaying red, blue or amber lights,
  • Using hazard lights,
  • Displaying caution signs or
  • Marked with flares or torches.
