Judge to Ariz. Officer: Apologize or Go to Jail

PHOENIX --

A Maricopa County detention officer was found in contempt of court and ordered by a judge to make a public apology.

Judge Gary Donahoe ruled that officer Adam Stoddard acted in contempt when he removed paperwork from a defense attorney's file during a criminal sentencing hearing.

During his contempt hearing, Stoddard claimed things he read in the documents led him to believe the defendant being sentenced may have posed a security risk. Stoddard said he took the papers to make copies.

The judge ordered Stoddard to hold a news conference in front of the Central Court Building in downtown Phoenix on or before Nov. 30, or face going to jail Dec. 1.

Sheriff Joe Arpaio called the judge's ruling bizarre.

"The judge does not run this office and tell my people to have press conferences," said Arpiao.

The sheriff added, "I back up the detention officer. He did the right thing acting in good faith in that courtroom."

The judge wrote in his order that the detention officer must give a verbal and written apology for invading the defense file and for the damage that his conduct may have caused her professional reputation. In his ruling, Donahoe stated that if the defense attorney does not find apology sufficient, Stoddard would go to jail.

When asked if he would order his detention officer not to comply with the judge's order, Arpaio reiterated, "I am saying that I decide who has the press conferences and who will talk."

A deputy county attorney who represents Stoddard and the sheriff's office in this case said he plans to file an appeal and ask for a stay of the Nov. 30 deadline.

WYF "if the defense attorney does not find the apology sufficient, Stoddard would go to jail" . I'm still not sure a crime was committed to begin with what wrong with this judge ?

To Judge Donahoe if by chance this post gets to you one way or another.....up yours ! Now take that contempt and stick it in the bank !

#1 The deputy shouldn't have done what he did.
#2 The judge does not have the authority to force the deputy to apologize
#3 I doubt the judge can invoke a more stiff penalty on the deputy for contempt than anyone else
#4 GOD BLESS SHERIFF JOE! It is great to see him continue to stand up for his troops. If his deputy was wrong for what he did, the department should handle it administratively, not publicly.

alot of times there is more to this story...I don't see a detention officer going thru someones paperwork without permission or it was paperwork needed for his job??? seems to me there is more to this story than is being told.

By what authority does this judge have to make the officer hold a news conference to apologize to some POS defense attorney working for the Mexican Mafia. I'm with Todd, hey judge F*%k You!

How about this for an apology. I am sorry that I tried to protect the judge in this court from what I believed to be a dangerous situation. I will never do that again. I will not try to stop any jail breaks if an attorney is part of the plan nor will I try to seize any evidence of the crime.

Alrighty.. What authority does this judge have to be able to tell some one to hold a public news conference and make a public apology.. Seems as if the power he does have has gone straight to his head.. Maybe he has little man syndrome. Im with the rest of the people, JUDGE YOU ARE A FREAKING IDIOT...

Okay, being from here I can tell you that this is all about the political turmoil within the county right now. That's all I can say about that. As for the officer, it's actually against policy for an officer to hold a press conference, and I'm glad the Sheriff is standing up for his people, just like he always does. When stuff like this happens no one mentions the fact that he saved hundreds of deputies and officers from being laid off due to misappropriation of funds by the board of supervisors by rebudgeting his office. LEOs around the country are being laid off but this man goes above and beyond to protect his people and ultimately protecting the public by ensuring no LEO is lost and the public maintains the level of service they deserve. He'll get my vote every 4 years until either he or I leave this earth!

Turns out the subject of the trial is a member of the Mex Mafia and his last two atty's were charged with bringing contraban into the jail. The DO saw something sticking out the the file in plain view on the desk which stated something to the effect "i'm going to seal... and the DO thought it better to take a look. Considering the past of this Atty's firm and the subject, it seemed like a good idea to look at something in palin view.

BTW, I am glad Sheriff Joe's supporting his troops. But, this just doesn't look right.
