Florida Officer Fired for Excessive Force

JACKSONVILLE, Fla. --

Sonji Hall-Brooks said she is relieved that Sheriff John Rutherford fired Officer R.T. Fraser after he shot her son, 20-year-old Jerrick Hall, in the shoulder.

"You can't really understand the logic of what we've been going through," Hall-Brooks said. "For me to see my son in the state that he's in for something senseless is crazy, and I was really happy, really happy about that."

The incident occurred in October when police responded to a burglary-in-progress call at a vacant home.

In April, Fraser told the police review board that Hall jumped out of a window and ran. The officer felt Hall had a weapon as Hall ran in the direction of another police officer.

"I felt that she was in some type of imminent danger," Fraser said. "Because I felt at the time he had some type of firearm or weapon in his waistband, there was no other resource at the time to prevent her from danger."

But in a memo from Rutherford, the sheriff found that the suspect was not seen with a weapon and had not threatened anyone, and deadly force was not appropriate.

Rutherford said officer Fraser broke policy and used excessive force, and he will be terminated.

"You just felt you were doing your job, but this time that you were doing your job, you did it in a wrong way," Hall-Brooks said.

Hall isn't ready to speak about what happened, but he has the bullet in his shoulder as an everlasting reminder.

"It's heartbreaking," Hall-Brooks said. "He could have lost his life. He still has a bullet in his chest. Every day he gets up and takes a bath, he's reminded of what this person did to him."

Yeah...just great...your stupid son should have been shot. Break-in to a home that's not your own you should expect to have some hot lead headed in your direction. The sheriff is bowing to the pressure...not much of a leader. IN FACT HE'S PART OF THE PROBLEM. SCREW YOU SHERIFF!

Pretty much shooting a fleeing felon is illegal, UNLESS there is a clear and present danger (displaying a weapon).

Had he been found with one, the sheriff would have been able to justify the shooting.

Many of the same agencies will mandate if you DO have to shoot, keep shooting till the threat is removed.

Jerrick Hall is lucky to be alive.

Officer R.T. Fraser committed no crime and should be able to be hired at another agency recognizing his experience.

I love how there is absolutely no accountability on the part of the mother of the criminal. This is ridiculous. Police officer are faced with split second decisions and this may or may not have been the right one, and the officer is fired as a result?!? Too harsh.

So much for the Graham vs Connor standard of objective reasonableness where the actions of an officer are judged by the split second decisions they have to make with the information at hand instead of the 20/20 vision of hindsight. I doubt he will get his job back even if he appeals it. This officers life is ruined because of a scumbag's decision to not do what over 95% of Americans do and that is to obey peoples' Constitutional rights to be secure in their homes and papers.

Glad I don't work for that Sheriff, but, it all boils down to politics. The small minority yelling loudly makes for a very limp spine. The majority of the community should stand up and let the sheriff know that they do not want criminals breaking into their homes. Occupied or not. You may be shot if you go into someone elses home.

This cop shoots a Burglar who was running toward another officer because he feels that the only way to save that officer is to fire his weapon and he is being hung out to dry??? Heavens no, let's not blame the criminal!!! (sarcasm)

You are a weak man, Sheriff John Rutherford. Stand up for what appears to be a good shoot and the officer who made that decision

A Real shame. The real victim is the homeowner, some punkass kid breaks into their home( whether thier home or not) you have been violated! Its very hard to feel safe in a home when a scumbag has torn through your belongings. so what this little prick got shot. sounds like the mother is cut from the same cloth!
