It's extremely common for first time DUI offenders to be cited and released... It's a misdemeanor.. Why should the guy have to face stiffer penalties? he's already faced a stiffer penalty than most other people would, he resigned from his job... I arrest people for DUI all the time who don't feel obligated/forced to resign and find a new job.
