Sound's like other states need a stand your gound law like Florida's. Repo folks need to know that going onto someone's property can get them killed, but to shot the owner even though he or she is behind in payments? Tank's family is about to get paid $$$!

Seems to me that he may have acted in self defense. Be prepared to get shot back at if you shoot first. The simple solution is give the car back to the bank if you can't afford it. Common sense says if you are not paying for your vehicle it will get the repo man coming to your door. You are not entitled to keep things because you are not able to pay for them. I myself would not shoot at someone for trying to steal my car. He should have called for some Law Enforcement help.

I worked at a bank and handled retail and auto loans before getting into Law Enforcement. Repossessions need to be handled like any other civil contract, a court order needs to be obtained and a writ of sequestration issued then a deputy sheriff needs to execute it on behalf of the lenders. No private firm or individual needs to be taking anyone's property without legal justification.

While I do not envy the Deputies that would have to do this, I agree wholeheartedly. Reposition companies are trying to make a buck which is the American way, but letting agents go at 3 AM to get a vehicle, while makes sense to some degree, only leads to situations like this. The fact that Smith brought a firearm with him shows the propensity for violence on both sides also. One can say he shot in self defense and be right, but in the long run, this is a situation that could have been handled in a completely different way and no one would have gotten hurt.

i live and work in fla......when doing repo s common sense goes a long way....if its in the country you can pretty much guarantee a gun lives there......so....a nice visit in daylight hours and a non combative attitude wins out most times ...

I tend to believe both parties are in the wrong on this. First off, There is no valid reason you would come out of your home and shoot at someone unless you feel your life is in danger. I understand that it happens though. Secondly if you knew you were behind on your car payments,everyone knows you might be getting a visit from the repo man. Maybe he though he was OK from the repo by the bankruptcy. Don't know.

As for the repo man. Why not get a real job. If a person chooses that occupation, you need to know that messing around someones home at 0300 hrs. might have dire consequences. Sounds to me like the repo man had a right to be where he was,it sounds like he had a right to be doing what he was doing. If his company had be involved in shootings before he might have been a little uneasy. If the vehicle owner shot at him,who in their right mind would not have shot back?

No one wins in this one. Under state law where I work, the DA won't have a case unless the repo man fired first. Makes you wonder don't it?
