No Third Trial for Cop Charged With Murder

The Hamilton County Prosecutor's Office announced Tuesday that it will not pursue a third trial against former University of Cincinnati Police Officer Ray Tensing, who was charged with murder in the fatal shooting of Sam DuBose.

The Hamilton County Prosecutor's Office announced Tuesday that it will not pursue a third trial against a former University of Cincinnati police charged with murder.

Prosecutor Joe Deters said that following discussions with "multiple jurors" after two mistrials in the case against Ray Tensing led him to make the decision, according to The Cincinnati Enquirer.

Deters is now dismissing the murder and voluntary manslaughter charges that the former officer has faced for nearly two years in the fatal shooting of Sam DuBose.

Stew Mathews, Tensing's attorney, said Deters did the right thing after two mistrials have been declared after the juries could not agree on verdicts.

Deters told reporters that despite his decision his beliefs on the case, in which Tensing fatally shot DuBose on July 19, 2015 as he tried to drive away from an off-campus traffic stop, have not changed.

"My opinion of this case has not changed as of two years tomorrow, and it is not going to change," he said. "In this case, we had jurors who would not vote to convict a police officer. Now, after two trials and probably a million dollars… I have come to the conclusion that we cannot win a trial in this case, with these facts."
