Man Sentenced for Threatening Officer

Jurors sentenced Miguel Angelo Gutierrez to a year in county jail -- the max allowed for the misdemeanor charge of making a terroristic threat.

A man who was facing up to 20 years in prison for allegedly yelling at a San Antonio police officer, "I am the head of the Mexican Mafia and I will kill you!" during a 2013 arrest was convicted by a jury this week of a lesser charge.

Jurors sentenced Miguel Angelo Gutierrez, 44, to a year in county jail -- the max allowed for the misdemeanor charge of making a terroristic threat -- after about 20 minutes of deliberation Wednesday in the 187th state District Court.

Officer Douglas Berry testified that after responding to a disturbance call at a convenience store where Gutierrez was causing a stir, he and another officer gave the man several chances to walk away before placing him under arrest.

Gutierrez, who has been in custody since the Sept. 16, 2013, incident, has 317 days credit for time served.
