Settlement Reached in Texas Wrongful Death Lawsuit

The San Antonio City Council has approved a settlement in a lawsuit filed against the city and the Police Department by the family of a woman killed in a car crash involving a police sergeant.

The San Antonio City Council has approved a settlement in a lawsuit filed against the city and the Police Department by the family of a woman killed in a car crash involving a police sergeant.

Family members of Rosita Davila filed the lawsuit after the March 2010 accident on Loop 1604. The settlement includes a $218,750 payout to Davila's four children.

An investigation by the San Antonio Police Department and the Texas Department of Public Safety determined Sgt. Gabe Trevino was driving a city-issued vehicle when he crashed into Davila's SUV. Davila died at the scene and her passenger was also injured.

The investigation also determined Trevino did not control his speed at the time of the crash. In the official accident report, both Trevino and Davila are listed at fault -- Trevino for failing to yield the right of way, and Davila for failing to take evasive action.

Trevino was suspended for 10-days after the investigation, but a grand jury declined to indict him after reviewing the evidence.
