Wisconsin Female Prison Guards Face Sexual Assault Charges

Two former female Oakhill prison guards are being charged with second-dagree sexual assault, even though they say the so-called victim -- a prisoner -- seduced them.

A year and a half ago, Correction's Secretary Matt Frank said he would enforce a "zero tolerance" policy for sexual contact between prison staff and inmates.

That is the background for what is believed to be the first case of its kind in Wisconsin.

On Thursday morning 39-year-old Christine Roberge, a former sergeant and 9-year prison veteran, and 29-year-old Heather Bartosch, who guarded inmates at Oakhill for seven years, will make initial court appearances on the sexual assault charges.

At the time of the alleged incidents last year both women were married -- Bartosch to a Fitchburg police detective.

A letter from the inmate that was found by Roberge's husband initiated the prison probe.

At first, the warden called the Fitchburg Police Department since Oakhill is in that jurisdiction. But Fitchburg couldn't investigate because one suspect was married to a staff member.

So the county investigated and found the inmate seduced the guards at different times into having sexual relations in secluded areas of the prison.

According to the complaint, one guard became concerned when he could not find Roberge, who had left her post. He saw her coming out of a towel room with a prisoner.

The other guard was concerned for his own safety, as well as the safety of other correctional officers because he was unsure of what lengths either of them might go to keep it quiet, WISC-TV reported.

Bartosch said she became smitten with an inmate and even bought him gifts.

"I crossed the line. I knew it. It scared me," she said. "I let myself get comfortable with someone I shouldn't have."

News 3 is not identifying the prisoner since he is a sexual assault victim.

The complaint also alleges that Roberge may have had a physical relationship with a second inmate, and wrote dirty letters to a third.

However, she is charged with just one count of second-degree sexual assault, as is Bartosch, which is a 40-year felony.

A correction's spokesman told News 3 that policies and procedures at Oakhill are now under review.

Sexual Assault
This is not sexual assualt or rape, whatever title u wish to place on it. The state fire them from thier jobs and remove any penisions. These were consenting adults and nothing more. these ladies made a mistake. The State has gone way over board on this whole sexual assualt subject men and women alike are now being falsely accused and lives are ruined for nothing. WE MUST BUT A STOP TO THIS.

This is an appalling abuse of power.It is also disgusting, that some people would think that this is not rape,or sexual assault. I feel sorry for their families. the humiliation they put people through so they could get off. And the gall, they have in trying to say it was nothing really. It was nothing to put people in danger? To belittle the atrocities, these women are nothing short of contemptuous,rabid,predators. This was no mistake.

Wisconsin Sexual Assault Charges
I agree that the guards abused their positions, and as none of us were there to witness what went on none of us can comment on the question of "rape". However having said that I do not agree with the sentence which in my view does not justify the crime.

I'll not say who I am, but will Strongly advise that the Wi. state DOC be continuously investigated, and I mean in Every Single Institution. There is MUCH more than can be believed going on within the fences & gates. Bribery, Theft, Sexual Misconduct (Regularly), Unacceptable Mistreatment of inmates-who are Human Beings By God, Gross Medical Neglect-Some To The "Near Death" Point...... Need I Say More? I Had to leave due to what all I saw/experienced daily. Watch These Facilities, send in undercover investigators (as inmates), do whatever, but stop this, Please.

These "officers" are a disgrace to the uniform, throw the book at them.

They need to have the definitions of "professional", "integrity", and "discipline" painted on their cells where they hopefully serve life sentences.

if the guards were male, and the prisioners female, would there be any doubt that they would be prosecuted. If they are going to prosecute male DOC officers for this activity they have to do the same when the officers are female, there is an assumption of power dynamics that make this important. Otherwise, if an female inmate says rape, the male officer says I was seduced....what then

I'm not sure what Robert G was reading, they admitted to the act. As for the charges, it does not matter if you were 'seduced' or not you are in position of authority and therefore it is an assault. JD & JK you are dead on with those comments.

I am a correctional Sgt. for DOC in Louisiana and I think that officers that get involved with a offender should be punished it is an insult to the people that wear the uniforms. It is the law that officers cant have sexual contact with offenders. Offenders are awarded to the state and has no say so about anything. Our officers know that offenders have no consent. I feel officers that do this should be punished.

I have no pity on those staff members. Why would you want to have relations with an inmate anyway? It makes me want to heave, and if I found out that any of my staff members was doing that, I'd rat them out immediately--in my humble opinion, all those 2 "women" are were opportunistic "s**ts" that should be in prison the rest of their lives--with the filth that they sleep with.

Prison Guard Misconduct
In the 1980's a female Milwaukee County sheriff deputy had an affair with an inmate,and smuggled a small hand gun to him which he subsequently used to kill Deputy Parks* who was transporting him to prison.No one was killed in this latest incident,but I'm I'm sure that The Parks family is problably shaking their heads in disgust right now asking,"When are they going to learn?"*I don't recall the name of the second officer-for which I apologize-who was also injured in that vicious attack.

In Closing,due to the serious nature,and potential danger of this incident,the authorities should send an unmistakably clear message that this sort of misconduct absolutely will not be tolerated by handing down -upon conviction-a tough sentence.
